Who can use the ATA Carnet

The holder of ATA Carnet can only be a domestic legal entity or a physical person.
ATA Carnet holder can have its Representative (one or more).
The representative is a person who travels with the Carnet, that is, a person who accompanies the goods. This may be the carrier itself or some other person authorized by the holder, and several persons can be appointed. If the representative is a foreign person or you do not know who is going to be in the column "Representative" instead of names the Letter of authority is entered. The form of the Letter of authority may be obtained in the Chamber of Economy of Montenegro - ATA Department in order for the representative to show it to the customs officer every time when he performs an operation of export / import / transit with the ATA Carnet.

Conditions for use of ATA Carnets

By the use of ATA Carnets, the goods crosses the border quickly and easily (without engaging freight forwarders), nevertheless certain rules and conditions must be obeyed:
a) all goods exported or imported under the ATA Carnet must be fully re-exported / re-imported in the same condition in which it was exported / imported (not intended for sale, rental, commercial maintenance, processing, repair, internal transport, industrial packaging or production, construction, commercial exploitation of natural resources, etc.).
b) All goods exported or imported under the ATA Carnet must be easily identified for export/ import and re-export/re-import (detailed description of the goods in the commodity list)
c) All figures included in the goods necessarily represent the true commercial value in the country of issue.
d) All holders must comply with national laws and regulations of the country of departure / countries that are visiting/transiting countries.
e) All the goods covered by the Carnet is subject to Customs inspection - Note 9 on the back green cover - and whenever the inspection is required by the Montenegrin Chamber of Economy.
f) The validity date of ATA Carnets is defined by the Chamber of Economy of Montenegro in accordance with the deadline stipulated by the Convention, or up to 12 months from the date of issue.
However, the customs authorities of member countries of the ATA chain may set a shorter term, in accordance with their national legislation, and in accordance with the relevant Conventions.
The use of the ATA Carnet is also being planned for transit through the country, under the terms of the ATA Convention.

The main categories of goods for which ATA Carnets are issued
• Fairs, exhibitions and presentations
• Professional equipment
• Other (sporting events, animals, etc.).

According to data provided by chambers of commerce engaged in ATA system, the main categories of goods temporarily imported under ATA Carnet are as follows:
Antiques, machinery, machine tools, catering equipment, canned food, shoes, toys, computers, office equipment, transformers, generators of electricity, electrical / electronic and scientific equipment, surgical and dental equipment, jewelry and precious metals / stones, stereo, audio-visual appliances, photographic equipment and film equipment, lasers, musical instruments and records, materials for display, aircraft, films, motor vehicles and accessories, racing engine machinery, equipment, heating and lighting, agricultural machinery, furniture, crockery, paintings and other works of art, umbrellas, racing horses, suitcases, perfume, theatrical effects and props, concert and musical instruments, leather and sports goods, clothing, yachts and boats, display stands.  
Under the ATA Carnet, consumables and perishable goods SHALL NOT BE imported, goods intended for processing, processing or repair, or advertising material which will be distributed at trade fairs or exhibitions in the territory of temporary import.  ATA Carnet is not issued for exhibitions organized for private purposes in shops or business premises for the sale of foreign goods. The number or the quantity of each thing must be reasonable, adjusted to the purpose of imports.
Except when permitted by national legislation of the country of temporary import, the goods granted temporary import may not:
a) be borrowed or in any used for rental or profit making,
b) be removed from the place where a certain event is taking place;

In short, the temporary import under the ATA Carnet is related to the goods to be re-exported in the same condition as when imported.
